Proview brings the fight to Apple in the US

If you have been following the news, you’re probably aware that Apple and Proview are currently embroiled in a legal battle over the iPad trademark. Long story short, Proview claims that Apple has no rights to the trademark, alleging that they deceived Proview by purchasing the rights through a shell company, while Apple alleges that they have the legal rights to the iPad name as the deal was completely legal with the rights to the name bought and paid for.

Now it looks like Proview may be taking the battle out of China and into US as the company has recently filed a lawsuit in Santa Clara County that basically brings the fight over into the US. Given the different IP laws in each country, the outcome could be different, and some legal experts are arguing that Apple could very well have the home ground advantage. We’re not sure what Proview is trying to achieve by bringing Apple to court in the US, but what we do know is they are seeking damages of several billion, while seeking to ban the sales of the iPad in China.

Either way with the iPad 3 rumored to be seeing a launch soon, we have to wonder if this lawsuit could damage or possibly even delay the launch of the highly anticipated tablet. We’ll be keeping our eyes and ears open for this one, so check back with us again for more updates.
