Samsung has found a legal loophole in which they are able to still sell their Galaxy Tab 10.1 tablets in Germany, despite the court’s decision to uphold the injunction that was initially requested by Apple. It seems that as long as Samsung Germany does not actually sell or distribute the tablets, they are in the clear, but obviously not content with a legal loophole and perhaps giving Apple the satisfaction of a victory, Samsung will be appealing the decision to the high courts this week.
Unfortunately it appears that the appeal could take several months, and may not be made in time for the holiday/winter season, although Samsung seems to be confident that it will. What do you guys think? Will Samsung be successful in the high court?
