Samsung to proceed with Galaxy Tab 10.1 sales in Australia

It was only just yesterday when Samsung announced that they will be halting the sales of the Samsung Galaxy Tab 10.1 Android tablets in Australia. This was in conjunction with the ongoing Apple vs Samsung patent infringement lawsuit where Apple is claiming that Samsung not only infringed on their patents, but also created products purposely designed to look like Apple’s iOS products.

Well fans of the Galaxy Tab 10.1 in Australia will not need to fret as it seems that Samsung will be proceeding with the sales after all, although based on how Samsung worded their statement, it probably has something to do with a legal loophole.

“No injunction was issued by the court and the parties in the case reached a mutual agreement which stipulates that the variant in question will not be sold in Australia,” the statement says. “A Samsung GALAXY Tab 10.1 for the Australian market will be released in the near future.”

Take note that in the initial report yesterday, there was no formal injunction by the courts, but rather it was Samsung who volunteered to halt the sales, even providing Apple with a few units of the tablet that they had planned to launch in Australia. As you can see by how Samsung worded their statement, they said that “a Samsung Galaxy Tab 10.1 for the Australian market” will be released, which means that it could be a different device from the one that Apple had initially wanted to ban, thus providing Samsung a legal loophole.

Naturally we think that this will not sit too well with Apple and their lawyers and they’re probably hard at work trying to get the ban in effect formally this time.
